Après avoir défini la notion de « jurisprudence », la contribution en détermine ses caractéristiques locales. Ainsi, l’innovation est profondément locale, tandis que la normativité des solutions jurisprudentielles résulte également de l’activité des tribunaux administratifs et des cours administratives d’appel. Dans la mesure où la construction de la jurisprudence dépend de l’ensemble des juridictions administratives, la contribution remet toutefois en cause la notion de « jurisprudence locale ». Une telle jurisprudence n’existe pas tout comme n’existerait pas non plus, à ce titre, une jurisprudence du Conseil d’État. L’ensemble des juridictions administratives contribuerait à l’élaboration de la jurisprudence administrative. The contribution consists in explaining the conditions of existence of local case law. After defining the concept of « case law », the contribution determines its local characteristics. Thus, innovation is profoundly local, while the normativity of case law also results from the activity of administrative tribunals and administrative courts of appeal. In so far as the construction of the case law depends on all the administrative courts, the contribution calls into question the concept of « local case law ». Such case law does not exist just as there would not exist, in this respect, case law of the Council of State.
