Ce dernier, inscrit à l’ancien article 1 395, interdisait ainsi aux époux de changer de régime matrimonial en cours d’union afin de préserver les intérêts du couple et de leurs enfants d’une part, des créanciers d’autre part. En effet, le mariage s’analysait alors comme un véritable pacte de famille garant de stabilité. Cette notion, pourtant jugée primordiale en 1804, a été assouplie progressivement par le législateur en cheminant d’une immutabilité stricte vers une mutabilité contrôlée, uniquement soumise à l’homologation du juge en présence de mineurs sous tutelle ou d’opposition. En outre, le délai préalable de deux ans, dernière relique du principe d’immutabilité absolue des situations matrimoniales, au cours duquel aucun changement de régime ne pouvait être intervenir, a également été abandonné. Le rôle du juge a néanmoins été substitué en faveur d’un autre intervenant : le notaire. Il lui incombe désormais le devoir d’alerter le juge lorsque le changement de régime projeté n’est pas conforme à l’intérêt de la famille. Originally marital situations respected a principle of immutability stemming from customary law then adopted by the framers of the Civil Code. This key concept was enshrined in the former Article 1 395 that prohibited spouses from changing their matrimonial regime during their union in order to protect the couple’s and children’s interests on one hand and those of the creditors on the other hand. Il existe aujourd’hui un véritable droit à l’autodétermination du sexe, entre féminin et masculin, toutefois circonscrit dans sa portée. En revanche, le droit interdit l’apposition de la mention « sexe neutre » à l’état civil. Il apparaît aujourd’hui que la mention du sexe à l’état civil est muable.
