La difficulté est ailleurs : améliorer l’articulation de ces différentes règles (civiles, pénales, prononcées par des magistrats très divers) et surtout leur mise en œuvre et donc leur effectivité. A great many criminal laws have been adopted over the past twenty years, which have made it possible to establish a comprehensive system for the prevention and repression of domestic violence. There are few, if any, real gaps in this system. Il existe aujourd’hui un véritable droit à l’autodétermination du sexe, entre féminin et masculin, toutefois circonscrit dans sa portée. En revanche, le droit interdit l’apposition de la mention « sexe neutre » à l’état civil. Il apparaît aujourd’hui que la mention du sexe à l’état civil est muable. The question of the mutability of sex registration has two aspects: the determination of sex and its consequences. On one hand, there is a genuine right to self‑determination of gender, between male and female, albeit limited in scope. On the other hand, the law prohibits the use of the term “gender‑neutral” in civil status documents.
